{"data":{"id":"us-ky/krs-363.785","jurisdiction":"us-ky","citation":"KRS 363.785","heading":"Retail electric vehicle charging license -- Annual fee -- Fund -- Required","body":"inspections -- Administrative regulations.\n(1) Beginning January 1, 2027, an electric vehicle power dealer shall not operate an\nelectric vehicle charging station witho ut first obtaining a retail electric vehicle\ncharging license from the department. A retail electric vehicle charging license shall\nbe valid from the date of issuance until January 31 of the following calendar year.\n(2) The department shall collect an annu al license fee in the amount of one hundred\ndollars ($100) per electric vehicle charging port located at an electric vehicle\ncharging station from the license holder to be deposited in the fund established in\nsubsection (3) of this section for the purpose of implementing and administering of\nthe retail electric vehicle charging program established by this section.\n(3) (a) There is hereby established in the State Treasury a trust and agency account to\nbe known as the retail electric vehicle charging station license fund. The fund\nshall consist of moneys received from the license fee imposed in subsection\n(2) of this section, state appropriations, gifts, grants, and federal funds.\n(b) The fund shall be administered by the department.\n(c) Amounts deposited in t he fund shall be used for the implementation and\nadministration of the electric vehicle charging station inspection program\nestablished by this section and for no other purpose.\n(d) Notwithstanding KRS 45.229, fund amounts not expended at the close of a\nfiscal year shall not lapse but shall be carried forward into the next fiscal year.\n(4) Except as provided in subsection (5) of this section, beginning January 1, 2027, the\ndepartment shall inspect each licensed electric vehicle charging station owned or\nleased by an electric vehicle power dealer at least once every two (2) years. The\ninspection shall include determinations of compliance with the standards in the\ncurrent edition of the National Institute of Standards and Technology's Handbook\n44 or other applicable standards relating to:\n(a) The accuracy of the meters and displays of the electric vehicle charging ports\nfrom which electricity is sold, including with regard to the electrical rate, the\ncharging speed, and the real -time charging status of the cust omer's electric\nvehicle;\n(b) Electrical and safety standards;\n(c) Output voltages from electric vehicle charging port connectors;\n(d) Security of payment methods and customer data; and\n(e) Any physical security or cybersecurity measures that the department may\nrequire.\n(5) Electric vehicle charging stations constructed using funds from the National\nElectric Vehicle Infrastructure Funding Program established under the federal\nInfrastructure Investment and Jobs Act, Pub. L. No. 117 -58, shall not be subject to\nthe licensure or inspection requirements of this section or administrative regulations\npromulgated under this section until five (5) years have elapsed from the initial date\nof operation o f the electric vehicle charging station and the long -term stewardship\nrequirement under 23 C.F.R. sec. 680.106 has expired.\n(6) Within ninety (90) days of July 15, 2026, the department shall promulgate\nadministrative regulations in accordance with KRS Chap ter 13A to establish\nelectric vehicle charging station inspection standards and to carry out and enforce\nthis section.","path":["KRS Chapter 363"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57948","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:00Z","sha256":"71e35f5d42eb4e845acac216ced1cb7753f0c825138517a25283c4496d0a105b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-363.780","next":"us-ky/krs-363.790"},"notice":"GroundRules: Original legal text.
