{"data":{"id":"us-ky/krs-363.900","jurisdiction":"us-ky","citation":"KRS 363.900","heading":"Definitions for KRS 363.900 to 363.908.","body":"As used in KRS 363.900 to 363.908, unless the context clearly requires otherwise:\n(1) \"ASTM International\" means the international standards developing organization\nthat provides a forum for the development and publication of international\nvoluntary consensus standards for materials, products, systems, and services;\n(2) \"Commissioner\" means the Commissioner of Agriculture or a departmental\nemployee designated by the Commissioner to act on his or her behalf for the\npurposes of KRS 363.900 to 363.908;\n(3) \"Department\" means the Kentucky Department of Agriculture;\n(4) \"Diesel\" means a refined hydrocarbon suitable for use as a fuel in a compression -\nignition internal combustion engine that may contain fuel additives and up to five\npercent (5%) by volume of biodiesel or biomass-based diesel;\n(5) \"Division\" means the Division of Regulation and Inspection in the Kentucky\nDepartment of Agriculture;\n(6) \"Gasoline\" means gasoline as defined in KRS 138.210;\n(7) \"Gasoline-oxygenate blend\" means a fuel consisting primarily  of gasoline blended\nwith more than one percent (1%) by volume oxygenate or more than three -tenths of\none percent (0.3%) by volume methanol. The term \"gasoline-oxygenate blend\" shall\ninclude gasoline -ethanol blends containing between one percent (1%) and f ifteen\npercent (15%) ethanol by volume;\n(8) \"Motor fuel\" means any product used for the generation of power in an internal\ncombustion or turbine engine including but not limited to gasoline, gasoline -\noxygenate blends, diesel fuel, and diesel fuel blended w ith biodiesel or biomass -\nbased diesel; and\n(9) \"Retail facility\" means a service station, garage, truck stop, or other outlet selling\nmotor fuel from a retail dispensing device.
