{"data":{"id":"us-ky/krs-365.070","jurisdiction":"us-ky","citation":"KRS 365.070","heading":"Injunction and damages for violation of KRS 365.020 to 365.050.","body":"(1) Any person may maintain an action to enjoin a continuance of any act in violation\nof any of the provisions of KRS 365.020 to 365.050, and if injured thereby for the\nrecovery of damages. If, in such action, the court finds that the defendant is\nviolating or has violated any of the provisions of KRS 365.020 to 365.050, it shall\nenjoin the defendant from a continuance thereof. It shall not be necessary that actual\ndamages to the plaintiff be alleged or proved. In addition to such injunctive relief,\nthe plaintiff in the action shall be entitled to recover from the defendant three (3)\ntimes the amount of any actual damages sustained. Any defendant in an action\nbrought under this section may be required to testify, and his books and records may\nbe brought into cou rt and introduced, by reference, into evidence, but no\ninformation so obtained shall be used against the defendant as a basis for a\nprosecution under the provisions of subsection (2) of KRS 365.990.\n(2) Any person who, as agent of any person or as directo r, officer or agent of any\ncorporation, assists or aids in a violation of any of the provisions of KRS 365.020 to\n365.050 by the person or corporation for which he is agent, director or officer, shall\nbe responsible therefor equally with such person or cor poration, and in any\nproceeding brought against him under subsection (1) of this section it shall be\nsufficient to allege and prove the unlawful intent of the person or corporation for\nwhom he acts.\n(3) The remedies prescribed by this section are cumulative.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34740","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:00Z","sha256":"33efb6287c717a533e3fc142d70efa7d214866fb742070208a550d80d5b64823","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.060","next":"us-ky/krs-365.080"},"notice":"GroundRules: Original legal text.
