{"data":{"id":"us-ky/krs-365.265","jurisdiction":"us-ky","citation":"KRS 365.265","heading":"Legislative findings.","body":"(1) The General Assembly hereby finds and declares as follows:\n(a) Cigarettes, because of their standardized character, their great popularity, their\nwidespread and varied types of markets and methods of distribution and the\nsensitivity of their distribution t o price fluctuations, possess a distinct\nmarketing character and, the economic facts and circumstances peculiar to\ntheir distribution, require special and individualized treatment of the problems\ncreated by the sale of cigarettes below cost.\n(b) The sale of cigarettes below cost for the purpose of destroying or substantially\nlessening competition is inimical to the orderly and efficient collection by the\nCommonwealth of excise taxes on cigarettes and taxes from the licensing of\npersons engaged in the sale of cigarettes at wholesale and retail.\n(c) The sale of cigarettes below cost for the purpose of destroying or substantially\nlessening competition is an unfair business practice, which tends to be\ndisorganizing in the sale and distribution of cigarettes, and  ultimately fosters\nmonopoly and high prices by tending to force independent wholesalers and\nretailers out of business.\n(2) The General Assembly hereby declares it to be the policy of this Commonwealth to\npromote the public welfare by prohibiting the sale of cigarettes below cost, and it is\nthe purpose of KRS 365.280 to carry out that policy in the public interest.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34763","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"42e31680d2c6c31dba56da328b29a9676e4f1b65c81dd1fe42eee911c37dda2c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.260","next":"us-ky/krs-365.270"},"notice":"GroundRules: Original legal text.
