{"data":{"id":"us-ky/krs-365.320","jurisdiction":"us-ky","citation":"KRS 365.320","heading":"Transactions permitted to meet lawful competition.","body":"(1) Any wholesaler may sell cigarettes to a regular customer at a price made in good\nfaith to meet the legal price of a competitor selling to the same customer. Any\nretailer may sell cigarettes at a price made in good faith to meet the legal price of a\ncompetitor. The price of cigarettes sold under the exceptions specified in KRS\n365.310 shall not be considered the price of a competitor and shall not be used as a\nbasis for establishing prices below cost, nor shall the price established at a\nbankruptcy sale be c onsidered the price of a competitor within the purview of this\nsection.\n(2) In the absence of proof of the actual cost to the competing wholesaler or to the\ncompeting retailer, as the case may be, the cost may be presumed to be the lowest\ncost to the whole saler or the lowest cost to the retailer, as the case may be, within\nthe same trading area as determined by a cost survey made pursuant to KRS\n365.360(2).","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34769","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"a0fa302147554973af4213a8dd37549b69eb01dd03ef594f83e4d87451e06bc7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.310","next":"us-ky/krs-365.330"},"notice":"GroundRules: Original legal text.
