{"data":{"id":"us-ky/krs-365.350","jurisdiction":"us-ky","citation":"KRS 365.350","heading":"Actions for violations or threatened violations -- Remedies -- Actual","body":"damages need not be alleged or proved -- Costs.\n(1) The department, or any person injured by any violation, or who may suffer injury\nfrom any threatened violation of KRS 365.260 to 365.380, may maintain an action\nin any court of equitable jurisdiction to prevent, restrain, or enjoin the violation or\nthreatened violation. If a violation or threatened violation of KRS 365.260 to\n365.380 shall be established, the court shall enjoin and restrain, or otherwise\nprohibit, the violations or threatened violation. In addition, the court shall assess in\nfavor of the plaintiff and against the defendant the cost of the suit, including\nreasonable attorney's fees. It shall not be necessary that actu al damages to the\nplaintiff be alleged or proved, but if alleged and proved, the plaintiff in the action,\nin addition to injunctive relief, the costs of the suit, and reasonable attorney's fees,\nshall be entitled to recover from the defendant the actual damages sustained by him.\n(2) If no injunctive relief is sought or required, any person injured by a violation of\nKRS 365.260 to 365.380 may maintain an action for damages and the costs of suit\nin any court of general jurisdiction.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34772","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"be8c6a2328b02edfeef7f940f7db38cd6bc8ceeb3d565305b214a53aa2ca6cfc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.340","next":"us-ky/krs-365.360"},"notice":"GroundRules: Original legal text.
