{"data":{"id":"us-ky/krs-365.400","jurisdiction":"us-ky","citation":"KRS 365.400","heading":"Definitions for KRS 365.400 to 365.408.","body":"As used in KRS 365.400 to 365.408, unless the context indicates otherwise:\n(1) \"Automatic renewal\" means a plan or arrangement in which a paid subscription,\nmembership, or purchase agreement is automatically renewed at the end of a\ndefinite paid term for a subsequent paid term of more than one (1) month;\n(2) \"Automatic renewal offer terms\" means the following clear and conspicuous\ndisclosures:\n(a) That the paid subscription or purchase agreement will continue until the\nconsumer cancels;\n(b) The description of the cancellation policy that applies to the offer;\n(c) The recurring charges that will be charged to the consumer's credit or debit\ncard or payment account with a third party as part of the automatic renewal\nplan or arrangement, that the amount of the c harge may change, if that is the\ncase, and the amount to which the charge will change, if known;\n(d) The length of the automatic renewal term or that the service is continuous,\nunless the length of the term is chosen by the consumer; and\n(e) The minimum purchase obligation, if any;\n(3) \"Clear and conspicuous\" means in larger type than the surrounding text, or in\ncontrasting type, font, or color to the surrounding text of the same size, or set off\nfrom the surrounding text of the same size by symbols or othe r marks, in a manner\nthat clearly calls attention to the language. In the case of an audio disclosure, \"clear\nand conspicuous\" and \"clearly and conspicuously\" mean in a volume and cadence\nsufficient to be readily audible and understandable;\n(4) \"Consumer\" means an individual who acquires goods or services for personal,\nfamily, or household purposes; and\n(5) \"Continuous service\" means a plan or arrangement in which a paid subscription or\npurchase agreement continues for an indefinite term until th e consumer cancels the\nservice.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54219","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"78ea301f644a73780bf3f470546774ae2945378393af7fe3d496b7111a2aacfa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.395","next":"us-ky/krs-365.402"},"notice":"GroundRules: Original legal text.
