{"data":{"id":"us-ky/krs-365.402","jurisdiction":"us-ky","citation":"KRS 365.402","heading":"Requirements of businesses offering automatic renewals or continuous","body":"service offers -- Cancellation or termination -- Notice of material change.\n(1) A business that makes an automatic renewal or continuous service offer to a\nconsumer in this state shall:\n(a) Present the automatic renewal offer terms or continuous service offer terms in\na clear and conspicuous manner before the subscription or purchase\nagreement is fulfilled and in visual proximity, or in the case of an offer\nconveyed by vo ice, in temporal proximity, to the request for consent to the\noffer. If the offer also includes a free gift or trial, the offer shall include a clear\nand conspicuous explanation of the price that will be charged after the trial\nends or the manner in which the subscription or purchase agreement pricing\nwill change upon conclusion of the trial;\n(b) Obtain the consumer's affirmative consent to the purchase agreement with the\nautomatic renewal offer terms or continuous service offer terms, including the\nterms of an automatic renewal offer or continuous service offer that is made at\na promotional or discounted price for a limited period of time, before charging\nthe consumer's credit or debit card, or the consumer's account with a third\nparty, for an automatic renewal offer or continuous service offer; and\n(c) Provide an acknowledgment that includes the automatic renewal offer terms\nor continuous service offer terms, cancellation policy, and information\nregarding how to cancel in a manner that is capable of being r etained by the\nconsumer. If the automatic renewal offer or continuous service offer includes\na free gift or trial, the business shall also disclose in the acknowledgment how\nto cancel, and allow the consumer to cancel, the automatic renewal or\ncontinuous service before the consumer pays for the goods or service.\n(2) A business that makes an automatic renewal offer or continuous service offer shall\nprovide a toll -free telephone number, electronic mail address, postal address if the\nseller directly bills the consumer, or another cost -effective, timely, and easy -to-use\nmechanism for cancellation that shall be described in the acknowledgment specified\nin subsection (1)(c) of this section.\n(3) A business that allows a consumer to accept an automatic renewal or co ntinuous\nservice online shall allow that consumer to terminate the automatic renewal or\ncontinuous service offer exclusively online which may include a termination e -mail\nformatted and provided by the business that a consumer can send to the business\nwithout additional information.\n(4) In the event of a material change in the terms of the automatic renewal or\ncontinuous service that has been accepted by a consumer in this state, the business\nshall provide the consumer with a clear and conspicuous notice of the material\nchange and provide information regarding how to cancel in a manner that is capable\nof being retained by the consumer.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54220","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"224a6ea674b54cce6a0fabe46aaca2904c51631e24cdcb6688b91896f38ead8f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.400","next":"us-ky/krs-365.404"},"notice":"GroundRules: Original legal text.
