{"data":{"id":"us-ky/krs-365.404","jurisdiction":"us-ky","citation":"KRS 365.404","heading":"Exemptions from applicability of KRS 365.400 and 365.402.","body":"KRS 365.400 and 365.402 shall not apply to:\n(1) Any service provided by a business or its affiliate where either the business or its\naffiliate is operating pursuant to a franchise issued by a political subdivision of this\nstate or a license, franchise, certificate, or other authorization issued by the\nKentucky Public Service Commission;\n(2) Any service provided by a business or its affiliate where either the business or its\naffiliate is regulated by the Kentucky Public Service Commission, the Federal\nCommunications Commission, or the Federal Energy Regulatory Commission;\n(3) Any person or entity that is an insurer as defined in KRS 304.1 -040 or regulated\nunder KRS Chapter 304 or an affiliate of that person or entity;\n(4) Any person or entity providing service contracts as described in KRS 304.5 -070 or\nan affiliate of that person or entity;\n(5) A bank as defined in 12 U.S.C. sec. 1813(a) or Subtitle 3 of KRS Chapter 286;\n(6) A federal or state credit union as defined in 12 U.S.C. sec. 1752 or a credit union as\ndefined in Subtitle 6 of KRS Chapter 286;\n(7) A savings association as defined in 12 U.S.C. sec. 1813(b);\n(8) A consumer loan company as licensed under Subtitle 4 of KRS Chapter 286;\n(9) Providers of in-vehicle, roadside assistance, or travel subscription services; or\n(10) Solid waste management services as defined in KRS 109.012.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54221","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"22d1f33060370bb38b67f4ae22bba59382cc52075ab4f0ff1a3a81d7c533855c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.402","next":"us-ky/krs-365.406"},"notice":"GroundRules: Original legal text.
