{"data":{"id":"us-ky/krs-365.406","jurisdiction":"us-ky","citation":"KRS 365.406","heading":"Penalties for violation of KRS 365.402.","body":"(1) If a business fails to comply with KRS 365.402 and it is the business's first\nviolation, the business shall provide a prorated refund for the contract subject to an\nautomatic renewal provision from the start of the most recent term to the date on\nwhich the business was notified of and corrects the error.\n(2) If the business fails to provide a prorated refund as required in subsection (1) of this\nsection or it is a business's second or subsequent violation, the Attorney General\nmay bring an action to obtain:\n(a) A temporary or permanent injunction prohibiting the use of any method, act,\nor practice in violation of KRS 365.402;\n(b) Restitution for consumers who are residents of this state and incurred a loss of\nmoney or property as the direct result of a violation of KRS 365.402; and\n(c) Penalties that shall not exceed five hundred dollars ($500) for each violation\nof KRS 365.402.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54222","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"c9a1b238ff33e3a44ba665a08e3d32be523afb257c57ab2e8e826c5d973c227a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.404","next":"us-ky/krs-365.408"},"notice":"GroundRules: Original legal text.
