{"data":{"id":"us-ky/krs-365.410","jurisdiction":"us-ky","citation":"KRS 365.410","heading":"Definitions.","body":"As used in KRS 365.410 to 365.480 and 365.992:\n(1) \"Going out of business sale\" means any sale, whether described by such name or by\nany other name such as, but not limited to, \"closing out sale,\" \"liquidation sale,\"\n\"lost our lease sale,\" \"forced to vacate sale,\" held in such a manner as to induce a\nbelief that upon disposal of the stock of goods on hand, the business will cease and\ndiscontinue at the premises where the sale is conducted.\n(2) \"Sale\" means a transfer of goods from the seller to the buyer for a price less than\nthat for which the goods were o riginally offered to the public by the person\nconducting a sale hereunder.\n(3) \"Fire sale\" means any sale held in such a manner as to induce a belief that the goods\nare being sold at a reduction in price due to damage by fire, smoke, water or\notherwise.\n(4) \"Cost\" means that price which the seller actually paid for goods.\n(5) \"Goods\" means all goods, wares, merchandise and other personal property,\nexcepting choses in action and money.\n(6) \"Person\" includes a person, firm, corporation, partnership, associati on or two (2) or\nmore persons having a joint or common interest.\n(7) \"Removal sale\" means any sale held in such a manner as to induce a belief that upon\ndisposal of the stock of goods on hand, the business will cease and discontinue at\nthe premises where t he sale is conducted, and thereafter will be moved to and\noccupy another location.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34778","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"24c3782d335e968099bf4086a743efb7828e5e745ce15862ad6562427f6ab76f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.408","next":"us-ky/krs-365.415"},"notice":"GroundRules: Original legal text.
