{"data":{"id":"us-ky/krs-365.430","jurisdiction":"us-ky","citation":"KRS 365.430","heading":"Issuance of license -- Scope of authorization.","body":"(1) The clerk, upon receipt of an application giving fully and completely the\ninformation under oath as required by KRS 365.420 and upon receipt of the fee\nprovided for in KRS 365.445, shall issue a license to the applicant, authorizing the\napplicant to advert ise, represent, and sell the particular goods so inventoried at the\ntime and place stated in the application and in true accordance with the provisions\nof KRS 365.410 to 365.480 and 365.992. The license shall be issued in duplicate\nand shall bear a number and date of its expiration. A license issued under KRS\n365.410 to 365.480 and 365.992 shall be granted and valid only for the sale of the\ninventoried goods which are the property of the licensee. The license shall apply\nonly to the premises specified in th e application, and it may not be transferred or\nassigned. If a licensee under KRS 365.410 to 365.480 and 365.992 is engaged in\nbusiness in other locations, advertising or offering of goods on behalf of the other\nlocations shall not represent or imply any p articipation in or cooperation with the\nsale on the premises specified in the license, nor shall any advertising or other\noffering of goods on behalf of the premises where the licensed sale is being\nconducted represent or imply any participation in or coop eration with the sale at\nother locations. No license under KRS 365.410 to 365.480 and 365.992 shall be\nissued to any person:\n(a) To conduct a sale in the trade name or style of a person in whose goods the\napplicant for the license has acquired a right or t itle thereto within twelve (12)\nmonths prior to the time of making application for the license.\n(b) To continue a sale in the name of a licensee under KRS 365.410 to 365.480\nand 365.992 whose goods the applicant acquired a right or title while the sale\nis in progress.\n(2) Paragraphs (a) and (b) of subsection (1) shall not apply to any person who has\nacquired a right, title, or interest in goods as an heir, devisee, or legatee or pursuant\nto an order or process of a court of competent jurisdiction.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34782","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"93cf1a9f7936995ee7aa8d5d26178a48ae44f1417a2a80840c363961d9506258","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.425","next":"us-ky/krs-365.435"},"notice":"GroundRules: Original legal text.
