{"data":{"id":"us-ky/krs-365.571","jurisdiction":"us-ky","citation":"KRS 365.571","heading":"Application for registration.","body":"(1) Subject to the limitations set forth in KRS 365.561 to 365.613, any person who uses\na mark in this state may file an application for registration of that mark in the office\nof the Secretary, in a manner prescribed by the Secretary as set out in administrative\nregulations promulgated by the Secretary. The filing shall include, but not be\nlimited to, the following:\n(a) The name and business address of the person applying for the registration and,\nif a corporation, the state of incorporation, or if a partnersh ip, the state in\nwhich the partnership is organized and the names of the general partners;\n(b) The goods or services on or in connection with which the mark is used, the\nmode or manner in which the mark is used on or in connection with the goods\nor services, and the class comprising the goods or services;\n(c) The date when the mark was first used anywhere and the date when it was first\nused in this state by the applicant or his predecessor-in-interest; and\n(d) A statement that the applicant is the owner of the mark, that the mark is in use\nin this state, and that, to the knowledge of the person verifying the application,\nno other person has registered, either federally or in this state, or has the right\nto use the mark in this state in an identical form or i n such near resemblance\nas to be likely, when used on or in connection with the goods or services of\nthe other person, to cause confusion or mistake, or to deceive.\n(2) The Secretary may require a statement as to whether any applications to register the\nmark or portions or a composite of it have been filed by the applicant or his\npredecessor-in-interest in the United States Patent and Trademark Office. The\nSecretary may require applicants who have or whose predecessors have filed with\nthe United States Pate nt and Trademark Office to include the filing date and serial\nnumber of each application, the status of the application and, whether the\napplication was finally refused registration or has otherwise not resulted in a\nregistration and the reasons therefor.\n(3) The Secretary may also require that a drawing of the mark, complying with\nrequirements specified by the Secretary, accompany the application.\n(4) The application shall be signed by the applicant or a person authorized to sign on\nbehalf of the applicant . The application shall contain a statement, under oath, that\nthe information provided is true, complete and correct. Any person who makes a\nmaterial false statement which he does not believe to be true in the application shall\nbe in violation of KRS 523.030.\n(5) The application shall be accompanied by three (3) specimens showing the mark as\nactually used.\n(6) The application shall be accompanied by an application fee of ten dollars ($10),\npayable to the Secretary.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34805","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"44fc6fa10969a9e18d0a50200075b6863beab599749c21a11e5ceb45de46ed66","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.570","next":"us-ky/krs-365.573"},"notice":"GroundRules: Original legal text.
