{"data":{"id":"us-ky/krs-365.581","jurisdiction":"us-ky","citation":"KRS 365.581","heading":"Duration and renewal.","body":"(1) A registration of a mark pursuant to KRS 365.561 to 365.613 shall be effective for a\nterm of five (5) years from the date of registration and, may be renewed for a like\nterm upon application filed within six (6) months prior to the expiration of the term,\nin a manner complying with the requirements of the Secretary as set out in\nadministrative regulation. A renewal fee of five dollars ($5), payable to the\nSecretary, shall accompany the application for renewal of the registration.\n(2) A registration may be r enewed for successive periods of five (5) years in this\nmanner.\n(3) The Secretary of State shall notify registrants of the necessity of renewing their\nregistrations at least six (6) months prior to their pending expiration by writing to\nthe last known address of the registrants.\n(4) Any registration in effect on July 15, 1994, shall continue in effect for the remainder\nof the unexpired term and may be renewed by filing an application for renewal with\nthe Secretary, if the application for renewal complies wi th the requirements of the\nSecretary as set out in administrative regulations and is accompanied by the renewal\nfee prescribed in subsection (1) of this section and submitted within six (6) months\nprior to the expiration of the registration.\n(5) All applications for renewal pursuant to this section, whether of registrations made\nunder KRS 365.561 to 365.613 or of registrations effected under any prior state law,\nshall include a verified statement that the mark has been and is still in use, and\ninclude a spe cimen showing actual use of the mark on or in connection with the\ngoods or services.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34810","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"34a7df0da7c096310359062cb7e2dff64d1ec200baaf91db1dc45aac34533e38","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.580","next":"us-ky/krs-365.583"},"notice":"GroundRules: Original legal text.
