{"data":{"id":"us-ky/krs-365.583","jurisdiction":"us-ky","citation":"KRS 365.583","heading":"Assignments, changes of name, and other instruments.","body":"(1) Any mark and its registration or application pursuant to KRS 365.561 to 365.613\nshall be assignable with the goodwill of the business in which the mark is used, or\nwith that part of the goodwill of the business connected with the use of and\nsymbolized by the mark. An assignment shall be in writing, duly executed, and may\nbe recorded with the Secretary upon the payment to the Secretary of a recording fee\nof five dollars ($5). The Secretary shall issue in the name of the assignee of a\nregistration a new certi ficate for the remainder of the term of the registration or\nrenewal period. An assignment of any registration shall be void as against any\nsubsequent purchaser for valuable consideration without notice, unless it is recorded\nwith the Secretary within three  (3) months after the date of the assignment or prior\nto the subsequent purchase.\n(2) Any registrant or applicant may record a certificate of change of name of the\nregistrant or applicant with the Secretary upon the payment of the recording fee\nprescribed in subsection (1) of this section. The Secretary may issue in the name of\nthe assignee a certificate of registration of an assigned application or a new\ncertificate or registration for the remainder of the term of the registration or last\nrenewal.\n(3) Other instruments relating to a registered mark or a pending application for\nregistration, for example, licenses, security interests, or mortgages, may be recorded\nin the discretion of the Secretary, if the instrument is in writing and duly executed.\n(4) Acknowledgement shall constitute a rebuttable presumption that an assignment or\nother instrument was executed and, when recorded by the Secretary, that record\nshall constitute a rebuttable presumption of execution.\n(5) A photocopy of any instrument referred to in subsections (1), (2), or (3) of this\nsection shall be accepted for recording if it is certified by any of the parties to the\ninstrument or their successors as a true and correct copy of the original.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34811","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"0c89b2b533d0894cf55d7d316e6a09bee192ba6d60bdccf75ae098c6a85fccd2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.581","next":"us-ky/krs-365.585"},"notice":"GroundRules: Original legal text.
