{"data":{"id":"us-ky/krs-365.607","jurisdiction":"us-ky","citation":"KRS 365.607","heading":"Forum for actions regarding registration -- Service on out -of-state","body":"registrants.\n(1) Actions to require cancellation of a mark registered pursuant to KRS 365.561 to\n365.613 or to compel registration of a mark pursuant to KRS 365.561 to 365.613\nshall be brought in the Franklin Circuit Court. In an action to compel registration,\nthe proceeding shall be based solely upon the record before the Secretary. In an\naction for cancellation, the Secretary shall not be made a party to the proceeding but\nshall be n otified of the filing of the complaint by the clerk of the Franklin Circuit\nCourt and shall be given the right to intervene in the action.\n(2) In any action brought against a nonresident registrant, service may be effected upon\nthe Secretary as agent for service of the registrant in accordance with the procedures\nestablished for service upon nonresident corporations and business entities under\nKRS 454.210(3).","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34823","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:01Z","sha256":"fcf3c56c8241760013fe0c534fa7ff055dd8fa97b040b63599075aa0d9303cee","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.605","next":"us-ky/krs-365.610"},"notice":"GroundRules: Original legal text.
