{"data":{"id":"us-ky/krs-365.680","jurisdiction":"us-ky","citation":"KRS 365.680","heading":"Permit fee -- Bond.","body":"(1) Each application for a transient merchant permit shall be accompanied by a permit\nfee pursuant to KRS 64.012, to be retained by the office of the county clerk or the\nofficer of an urban -county government having the responsibility for the issuance of\nbusiness permits and licenses generally. In addition, any applicant who will be\nselling goods, wares or merchandise during the permit period which have an\naggregate market value of one thousand five hundred dollars ($1,500) or more, shall\nsecure and submit evide nce of security, a cash bond or a surety bond in the amount\nof one thousand dollars ($1,000) or five percent (5%) of the retail value of any\ngoods, wares or merchandise to be offered for sale, whichever sum is greater. Such\nevidence of security shall be he ld by the Attorney General and he shall issue a\ncertificate of security to be used by the applicant as evidence of security.\n(2) The surety bond required by this section shall be in favor of the Commonwealth of\nKentucky and shall assure the payment by the applicant of all taxes that may be due\nfrom the applicant to the state or any political subdivision of the state, the payment\nof any fines that may be assessed against the applicant or its agents or employees for\nviolation of the provisions of KRS 365.650 to 365.695, and for the satisfaction of\nall judgments that may be rendered against the transient merchant or its agents or\nemployees in any cause of action commenced by any purchaser of goods, wares or\nmerchandise within one (1) year from the date of the s ale by such transient\nmerchant.\n(3) The bond shall be maintained so long as the transient merchant conducts business in\nthe Commonwealth of Kentucky and for a period of one (1) year after the\ntermination of such business and shall be released only when the  transient merchant\nfurnishes satisfactory proof to the Attorney General that it has satisfied all claims of\npurchasers of goods, wares or merchandise from such merchant, and that all state\nand local sales taxes and other taxes have been paid.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34836","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:02Z","sha256":"eb7c97e2acfc9c88f2fb0e19504b0fb1806572d6320c2c16c9d4093b8f9acb5e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.675","next":"us-ky/krs-365.685"},"notice":"GroundRules: Original legal text.
