{"data":{"id":"us-ky/krs-365.782","jurisdiction":"us-ky","citation":"KRS 365.782","heading":"Prohibition against the use of false, deceptive, or misleading affiliation","body":"between a performing group and recording group in a live musical\nperformance or production.\n(1) A person shall not advertise or conduct a live musical performance or p roduction in\nthis Commonwealth through the use of a false, deceptive, or misleading affiliation,\nconnection, or association between a performing group and a recording group.\n(2) This section shall not apply if:\n(a) The performing group is the authorized re gistrant and owner of a federal\nservice mark or trademark for the recording group which is:\n1. Registered in the United States; or\n2. A licensee of or otherwise authorized to use the mark by such registrant\nand owner;\n(b) At least one (1) member of the per forming group was a member of the\nrecording group and that member has a legal right to use or operate under the\nname of the recording group without having abandoned the name or affiliation\nwith the recording group;\n(c) The live musical performance or production is identified in all advertising and\npromotion as a salute or tribute and the name of the performing group is not\nconfusingly similar to a recording group; or\n(d) The performance or production is expressly authorized by the recording\ngroup.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52624","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:02Z","sha256":"3a71b0bdb26903af6a653f57c38d105fcdb78e46a8b044971270795bdec48cd5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.780","next":"us-ky/krs-365.784"},"notice":"GroundRules: Original legal text.
