{"data":{"id":"us-ky/krs-365.800","jurisdiction":"us-ky","citation":"KRS 365.800","heading":"Definitions for KRS 365.800 to 365.840.","body":"As used in KRS 365.800 to 365.840, unless the context requires otherwise:\n(1) \"Current net price on parts\" means the price listed by a supplier in a price list or\ncatalogue in effect at the time a retail agreement contract is terminated, less any\napplicable trade and cash discounts;\n(2) \"Retailer\" means any person, firm, or corporation, including heirs, personal\nrepresentatives, guardians, trustees, assignees, or receivers of the person, firm, or\ncorporation, engaged in the business of selling and retailing  inventory, but shall not\ninclude retailers of petroleum or motor vehicle and related automotive care and\nreplacement products;\n(3) \"Inventory\" means farm implements, tractors, farm machinery, consumer products,\nutility and industrial equipment, constructi on and excavating equipment, and any\nattachments, repair parts, or superseded parts for the equipment;\n(4) \"Net cost\" means the price a retailer paid for the inventory to a supplier, less all\ndiscounts allowed;\n(5) \"Consumer products\" means machines design ed for or adapted and used for\nhorticulture, floriculture, landscaping, grounds maintenance, or turf maintenance,\nincluding but not limited to lawnmowers, rototillers, trimmers, blowers, and other\nequipment used in both residential and commercial lawn, gar dening, or turf\nmaintenance, installation, or other applications;\n(6) \"Superseded parts\" means any part that will provide the same function as a currently\navailable part as of the date of termination of a retail agreement contract;\n(7) \"Supplier\" means an y wholesaler, manufacturer, or distributor of inventory, or any\npurchaser of assets or stock of any surviving corporation resulting from a merger or\nliquidation, or any receiver, assignee, or trustee of the original wholesaler,\nmanufacturer, distributor, or corporation; and\n(8) \"Terminate\" or \"termination\" means cancel, fail to renew, or otherwise terminate a\nretail agreement contract.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42578","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:02Z","sha256":"d8acc16ab05bdcabed2b7186e2f05d29efc32e2264ca9fd8a299ad89d5d09975","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.784","next":"us-ky/krs-365.805"},"notice":"GroundRules: Original legal text.
