{"data":{"id":"us-ky/krs-365.810","jurisdiction":"us-ky","citation":"KRS 365.810","heading":"Prices to be paid by supplier for repurchase of inventory and hardware,","body":"software, repair tools, signage and fixtures required by the supplier --\nReimbursement for training.\n(1) (a) The supplier shall repurchase inventory previously purchased from the\nsupplier and held by the retailer on the date of termination of the retail\nagreement contract. The supplier shall pay one hundred percent (100%) of the\nnet cost, plus any freight charges paid, of all new, unsold, undamaged, and\ncomplete farm implements, tr actors, farm machinery, utility and industrial\nequipment, construction and excavating equipment, consumer products, and\nany attachments for the equipment, and one hundred percent (100%) of the\ncurrent net price of all new, unused, and undamaged repair parts or superseded\nparts.\n(b) The supplier shall repurchase inventory used in demonstrations, including\ninventory leased or rented primarily for demonstration or lease purposes, at its\nagreed depreciated value, if the equipment is in like -new condition and ha s\nnot been damaged.\n(2) The supplier shall pay the retailer five percent (5%) of the current net price on all\nnew, unused, and undamaged repair parts or superseded parts returned to cover the\ncost of handling, packing, and loading. The supplier may perform  the handling,\npacking, and loading in lieu of paying the five percent (5%) of the current net price\nfor these services.\n(3) (a) The supplier shall purchase from the retailer, at its amortized value, any\nspecific data processing hardware and software and t elecommunications\nequipment that the supplier required the retailer to purchase within five (5)\nyears of the termination of the retail agreement contract.\n(b) The supplier shall repurchase from the retailer, at seventy -five percent (75%)\nof the net cost, s pecialized repair tools purchased within three (3) years of the\ndate of the termination of the retail agreement contract, and, at fifty percent\n(50%) of the net cost, specialized repair tools purchased more than three (3)\nbut less than six (6) years of the date of the termination of the retail agreement\ncontract if:\n1. The supplier required the purchase;\n2. The retailer held the tools on the date of the termination of the retail\nagreement contract;\n3. The tools were unique to the supplier's product line; and\n4. The tools were in complete and resalable condition.\n(4) The supplier shall purchase from the retailer, at its amortized value, any specific\nsignage incorporating the supplier's name, logo, tradename, trademark, or other\ninformation identifying the sup plier or the products manufactured or distributed by\nthe supplier which the supplier expressly required the retailer to purchase in\nconnection with the retail agreement contract.\n(5) If, in a retail agreement contract, the supplier requires the retailer's employees to\nparticipate in training programs sponsored or promoted by the supplier, then the\nsupplier shall reimburse the retailer for any out -of-pocket expenses incurred by the\nretailer. The reimbursement shall only be required if the training took place  within\none (1) year of the termination of the retail agreement contract.\n(6) The supplier shall purchase from the retailer, at its amortized value, all trade\nfixtures and other improvements to the business premises of the retailer that the\nsupplier expressly required the retailer to purchase or acquire in connection with the\nretail agreement contract.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34851","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:02Z","sha256":"efac3f2a6f81fb8d476e972ac6bbf42cdeaf9eac0f14c2fbe567d65a0376ff04","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.805","next":"us-ky/krs-365.815"},"notice":"GroundRules: Original legal text.
