{"data":{"id":"us-ky/krs-365.833","jurisdiction":"us-ky","citation":"KRS 365.833","heading":"Claims by retailers for payment under warranty agreements.","body":"(1) Claims filed by a retailer for payment under warranty agreements shall be approved\nor disapproved within thirty (30) days of receipt by the supplier. All claims for\npayment shall be paid within thirty (30) days of their approval. If any claim is\ndisapproved, the supplier shall notify the retailer within thirty (30) days stating the\nspecific grounds upon which the disapproval is based. If a claim is not specifically\ndisapproved within thirty (30) days of receipt, it shall be deemed approved and\npayment by the supplier shall be within thirty (30) days.\n(2) If, after termination of a retail agreement contract, a retailer submits a claim to the\nsupplier for warranty work performed prior to the effective date of the termination,\nthe supplier shall accept or rejec t the claim within thirty (30) days of receipt. All\nclaims for payment shall be paid within thirty (30) days of their acceptance. If any\nclaim is rejected, the supplier shall notify the retailer within thirty (30) days stating\nthe specific grounds upon whi ch the rejection is based. If a claim is not specifically\nrejected within thirty (30) days of receipt, it shall be deemed accepted and payment\nby the supplier shall be within thirty (30) days.\n(3) Warranty work performed by a retailer shall be compensated in accordance with the\nreasonable and customary amount of time required to complete the work, expressed\nin hours and fractions of hours, multiplied by the retailer's established customer\nhourly retail labor rate, which shall have previously been made known  to the\nsupplier.\n(4) Expenses expressly excluded under the supplier's warranty to the customer shall not\nbe included nor required to be paid on requests for compensation from a retailer for\nwarranty work performed.\n(5) Expenses for all parts used by a ret ailer in performing warranty work shall be paid\nto the retailer in the amount equal to the retailer's net price for parts used, plus a\nminimum of fifteen percent (15%). The percentage additive is to reimburse the\nretailer for reasonable costs of doing business in performing warranty service on the\nsupplier's behalf, including but not limited to freight and handling costs incurred.\n(6) The supplier has the right to adjust for errors discovered during audit and, if\nnecessary, to adjust claims paid in error.\n(7) A retailer may accept the manufacturer's reimbursement terms and conditions in lieu\nof the other provisions provided by this section.","path":["KRS Chapter 365"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34858","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:02Z","sha256":"c3870199608180be5279ec74e0ae414b0fa726b9da6dec75876c4b25b00b0e52","source_id":"us-ky","stale":false,"prev":"us-ky/krs-365.832","next":"us-ky/krs-365.834"},"notice":"GroundRules: Original legal text.
