{"data":{"id":"us-ky/krs-367.210","jurisdiction":"us-ky","citation":"KRS 367.210","heading":"Powers of receiver -- Distribution of assets.","body":"Whenever a receiver is appointed by the court pursuant to KRS 367.110 to 367.300, he\nshall have the power to sue for, collect, receive and take into his possession all the goods\nand chattels, rights and credits, moneys and effects, lands and tenements, boo ks, records,\ndocuments, papers, choses in action, bills, notes and property of every description,\nderived by means of any practice declared to be illegal and prohibited by KRS 367.110 to\n367.300, including property with which such property has been mingled  if it cannot be\nidentified in kind because of such commingling, and to sell, convey, and assign the same\nand hold and dispose of the proceeds thereof under the direction of the court. Any person\nwho has suffered damages as a result of the use or employmen t of any unlawful practices\nand submits proof to the satisfaction of the court that he has in fact been damaged, may\nparticipate with general creditors in the distribution of the assets to the extent he has\nsustained out-of-pocket losses. In the case of a partnership or business entity, the receiver\nshall settle the estate and distribute the assets under the direction of the court.
