{"data":{"id":"us-ky/krs-367.220","jurisdiction":"us-ky","citation":"KRS 367.220","heading":"Action for recovery of money or property -- When action may be brought.","body":"(1) Any person who purchases or leases goods or services primarily for personal, family\nor household purposes and thereby suffers any ascertainable loss of money or\nproperty, real or personal, as a result of the use or employment by another person of\na method, act or practice declared unlawful by KRS 367.170, may bring an action\nunder the Rules of Civil Procedure in the Circuit Court in which the seller or lessor\nresides or has his principal place of business or is doing business, or in the Circuit\nCourt in wh ich the purchaser or lessee of goods or services resides, or where the\ntransaction in question occurred, to recover actual damages. The court may, in its\ndiscretion, award actual damages and may provide such equitable relief as it deems\nnecessary or proper. Nothing in this subsection shall be construed to limit a person's\nright to seek punitive damages where appropriate.\n(2) Upon commencement of any action brought under subsection (1) of this section, the\nclerk of the court shall mail a copy of the complain t or other initial pleading to the\nAttorney General and, upon entry of any judgment or decree in the action, shall mail\na copy of such judgment or decree to the Attorney General.\n(3) In any action brought by a person under this section, the court may award , to the\nprevailing party, in addition to the relief provided in this section, reasonable\nattorney's fees and costs.\n(4) Any permanent injunction, judgment or order of the court made under KRS 367.190\nshall be prima facie evidence in an action brought unde r this section that the\nrespondent used or employed a method, act or practice declared unlawful by KRS\n367.170.\n(5) Any person bringing an action under this section must bring such action within one\n(1) year after any action of the Attorney General has bee n terminated or within two\n(2) years after the violation of KRS 367.170, whichever is later.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34922","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:03Z","sha256":"1d669c3d18289633c9d8d7a9936db84ccf99c31c42f9fd6af9fc2b69befaafa3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.210","next":"us-ky/krs-367.230"},"notice":"GroundRules: Original legal text.
