{"data":{"id":"us-ky/krs-367.240","jurisdiction":"us-ky","citation":"KRS 367.240","heading":"Investigation -- Demand for information or evidence.","body":"(1) When the Attorney General has reason to believe that a person has engaged in, is\nengaging in, or is about to engage in any act or practice declared to be unlawful by\nKRS 367.110 to 367.300, or when he believes it to be in the public interest that an\ninvestigation should be made to ascertain whether a person in fact has engaged in, is\nengaging in or is about to engage in, any act or practice declared to be unlawful by\nKRS 367.110 to 367.300, he may execute in writing and cause to be served upon\nany person wh o is believed to have information, documentary material or physical\nevidence relevant to the alleged or suspected violation, an investigative demand\nrequiring such person to furnish, under oath or otherwise, a report in writing setting\nforth the relevant f acts and circumstances of which he has knowledge, or to appear\nand testify or to produce relevant documentary material or physical evidence for\nexamination, at such reasonable time and place as may be stated in the investigative\ndemand, concerning the adve rtisement, sale or offering for sale of any goods or\nservices or the conduct of any trade or commerce that is the subject matter of the\ninvestigation. Provided however, that no person who has a place of business in\nKentucky shall be required to appear or p resent documentary material or physical\nevidence outside of the county where he has his principal place of business within\nthe Commonwealth.\n(2) At any time before the return date specified in an investigative demand, or within\ntwenty (20) days after the d emand has been served, whichever period is shorter, a\npetition to extend the return date, or to modify or set aside the demand, stating good\ncause, may be filed in the Circuit Court where the person served with the demand\nresides or has his principal place of business or in the Franklin Circuit Court.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34924","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:03Z","sha256":"059eba64ac114f0bbd7cd2784581ca19bbfde6b79bdb0d87afc11a40f4420a1e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.230","next":"us-ky/krs-367.250"},"notice":"GroundRules: Original legal text.
