{"data":{"id":"us-ky/krs-367.3623","jurisdiction":"us-ky","citation":"KRS 367.3623","heading":"De -identifiable data requirements -- Construction -- Limitation of","body":"consumer rights on pseudonymous data -- Controller oversight of de -\nidentifiable or pseudonymous data.\n(1) The controller in possession of de-identified data shall:\n(a) Take reasonable measures to ensure the data cannot be associated with a\nnatural person;\n(b) Publicly commit to maintaining and using de -identified data without\nattempting to re-identify the data; and\n(c) Contractually obligate any recipients of the de -identified data to comply with\nall provisions of KRS 367.3611 to 367.3629.\n(2) Nothing in KRS 367.3611 to 367.3629 shall be construed to require a controller or\nprocessor to:\n(a) Re-identify de-identified data or pseudonymous data; or\n(b) Maintain data in identifiable form, or collect, obtain, retain, or access any data\nor technology, in order to be capable of associating an authenticated consumer\nrequest with personal data.\n(3) Nothing in KRS 367.3611 to 367.3629 shall be construed to require a controller or\nprocessor to comply with an authenticated consumer rights request pursuant to KRS\n367.3615 if:\n(a) The controller is not reasonably capable of associating the request with the\npersonal data or it would be unreasonably burdensome for the controller to\nassociate the request with the personal data;\n(b) The controller does not use the personal data to recognize or respond to the\nspecific consumer who is the subject of the personal data, or associate the\npersonal data with other personal data about the same specific consumer; and\n(c) The controller does not sell the personal data to any third party or otherwise\nvoluntarily disclose the personal data to any third party other than a processor,\nexcept as otherwise permitted in this section.\n(4) The consumer rights contained in KRS 367.361 5 shall not apply to pseudonymous\ndata in cases where the controller is able to demonstrate any information necessary\nto identify the consumer is kept separately and is subject to appropriate technical\nand organizational measures to ensure that the persona l data is not attributed to an\nidentified or identifiable natural person.\n(5) A controller that discloses pseudonymous data or de -identified data shall exercise\nreasonable oversight to monitor compliance with any contractual commitments to\nwhich the pseudo nymous data or de -identified data is subject and shall take\nappropriate steps to address any breaches of those contractual commitments.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55842","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:03Z","sha256":"5011e383714bbf8ee24c2cd789358c3f57ce657dcef700459959f6674e7ea7df","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.3621","next":"us-ky/krs-367.3625"},"notice":"GroundRules: Original legal text.
