{"data":{"id":"us-ky/krs-367.3627","jurisdiction":"us-ky","citation":"KRS 367.3627","heading":"Enforcement authority of Attorney General -- Written notice of violation","body":"-- Civil action -- Damages -- Recovery of expenses.\n(1) The Attorney General shall have exclusive authority to enforce violations of KRS\n367.3611 to 367.3629. The  Attorney General may enforce KRS 367.3611 to\n367.3629 by bringing an action in the name of the Commonwealth of Kentucky or\non behalf of persons residing in this Commonwealth. The Attorney General shall\nhave all powers and duties granted to the Attorney Ge neral under KRS Chapter 15\nto investigate and prosecute any violation of KRS 367.3611 to 367.3629. The\nAttorney General may demand any information, documentary material, or physical\nevidence from any controller or processor believed to be engaged in, or ab out to\nengage in, any violation of KRS 367.3611 to 367.3629.\n(2) Prior to initiating any action for violation of KRS 367.3611 to 367.3629, the\nAttorney General shall provide a controller or processor thirty (30) days' written\nnotice identifying the specifi c provisions of KRS 367.3611 to 367.3629, the\nAttorney General alleges have been or are being violated. If within the thirty (30)\ndays the controller or processor cures the noticed violation and provides the\nAttorney General an express written statement th at the alleged violations have been\ncured and that no further violations shall occur, no action for damages under\nsubsection (3) of this section shall be initiated against the controller or processor.\n(3) If a controller or processor continues to violate K RS 367.3611 to 367.3629\nfollowing the cure period in subsection (2) of this section or breaches an express\nwritten statement provided to the Attorney General under subsection (2) of this\nsection, the Attorney General may initiate an action and seek damages  for up to\nseven thousand five hundred dollars ($7,500) for each continued violation under\nKRS 367.3611 to 367.3629.\n(4) Nothing in KRS 367.3611 to 367.3629 or any other law, regulation, or the\nequivalent shall be construed as providing the basis for, or g ive rise to, a private\nright of action for violations of KRS 367.3611 to 367.3629.\n(5) The Attorney General may recover reasonable expenses incurred in investigating\nand preparing the case, court costs, attorney's fees, and any other relief ordered by\nthe court of any action initiated under KRS 367.3611 to 367.3629.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55844","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:03Z","sha256":"3b9d6580d898f7c65694fdefcb3105a48dd47a309b9db0a2ac06632c52675549","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.3625","next":"us-ky/krs-367.3629"},"notice":"GroundRules: Original legal text.
