{"data":{"id":"us-ky/krs-367.364","jurisdiction":"us-ky","citation":"KRS 367.364","heading":"Persons not required to place a security freeze on a consumer report.","body":"The following persons are not required to place a security freeze on a consumer report in\naccordance with KRS 367.363 to 367.365:\n(1) A check services or fraud prevention services company, which issues reports on\nincidents of fraud or authorizations for th e purpose of approving or processing\nnegotiable instruments, electronic funds transfers, or similar methods of payments;\n(2) A deposit account information service company, which issues reports regarding\naccount closures due to fraud, substantial overdrafts , automated teller machine\n(ATM) abuse, or similar negative information regarding a consumer to inquiring\nbanks or other financial institutions for use only in reviewing a consumer request\nfor a deposit account at the inquiring bank or financial institution;\n(3) A reseller of credit information that assembles or merges information contained in\nthe database of another consumer reporting agency or multiple consumer reporting\nagencies, and does not maintain a permanent database of credit information from\nwhich new consumer reports are produced;\n(4) Any database or file which consists solely of any information adverse to the\ninterests of the consumer, including but not limited to criminal record information,\nwhich is used for fraud prevention or detection, tenan t screening, employment\nscreening, or any purpose permitted by the federal Fair Credit Reporting Act, 15\nU.S.C. sec. 1681b;\n(5) A person to the extent such person offers fraud prevention services that issues\nreports on incidents of fraud or reports used pr imarily in the detection or prevention\nof fraud;\n(6) A bank, as defined in 12 U.S.C. sec. 1813(a) or Subtitles 1, 2, and 3 of KRS\nChapter 286;\n(7) A credit union, as defined in 12 U.S.C. sec. 1752 or Subtitle 6 of KRS Chapter 286;\n(8) A savings association , as defined in 12 U.S.C. sec. 1813(b), or an association, as\ndefined in Subtitle 5 of KRS Chapter 286;\n(9) An insurer, as defined in KRS Chapter 304; and\n(10) A retail establishment selling its own inventory.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34936","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:03Z","sha256":"a971378707bfa23a322854df2d1e947f4282ea76ed3bdc6045654c6664dd1432","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.363","next":"us-ky/krs-367.3645"},"notice":"GroundRules: Original legal text.
