{"data":{"id":"us-ky/krs-367.372","jurisdiction":"us-ky","citation":"KRS 367.372","heading":"Definitions for KRS 367.372 to 367.378.","body":"As used in KRS 367.372 to 367.378, unless the context requires otherwise:\n(1) \"Building materials\" means lumber, construction tools, windows, and anything else\nused in the building or rebuilding of property;\n(2) \"Consumer food item\" means any article used or intended for use for food, drink,\nconfection, or condiment by a person or animal;\n(3) \"Cost\" means any cost directly or indirectly related to the sale of a good, provision\nof a service, or the operation of the seller's business, and includes any actual or\nanticipated replacement cost;\n(4) \"Emergency supplies\" includes but is not limited to water, flashlights, radios,\nbatteries, candles, blankets, soap, diapers, temporary shelters, tape, toiletries,\nplywood, nails, and hammers;\n(5) \"Gasoline\" means any fuel used to power any motor vehicle or power tool;\n(6) \"Goods\" has the same meaning as in KRS 355.2-105;\n(7) \"Housing\" means any rental housing and includes any housing provided by a hotel\nor motel;\n(8) \"Medical supplies\" includes but is not limited to pres cription and nonprescription\nmedications, bandages, gauze, isopropyl alcohol, and antibacterial products;\n(9) \"Person\" has the same meaning as in KRS 446.010;\n(10) \"Price prior to the declaration\" means the person's price for a good or service on the\nday before the date of the Governor's order implementing the provisions of KRS\n367.374;\n(11) \"Repair or reconstruction services\" means services performed by any person for\nrepairs to residential or commercial property of any type that is damaged as a result\nof a natural or man -made disaster or emergency resulting from an event referred to\nin subsection (13) of this section;\n(12) \"Services\" means work, labor, or services, including services furnished in\nconnection with the sale or repair of goods or real property  or improvements\nthereto;\n(13) \"State of emergency\" means a natural or man -made disaster resulting from a\ntornado, earthquake, flood, fire, riot, storm, act of war, threat of war, military\naction, the time of instability following a terrorist attack, or an y other event for\nwhich a state of emergency has been proclaimed by the President of the United\nStates or declared by the Governor. It shall also include the duration of a Condition\nRed as declared by the United States Department of Homeland Security under  the\nHomeland Security Advisory System; and\n(14) \"Transportation, freight, and storage services\" means any service that is performed\nby a person that contracts to move, store, or transpor t personal or business property\nor rents equipment for those purposes.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47752","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:03Z","sha256":"7ea4c439908b115be16f54578aa32ea907f3dbcf421749e8abb2167443353792","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.370","next":"us-ky/krs-367.374"},"notice":"GroundRules: Original legal text.
