{"data":{"id":"us-ky/krs-367.401","jurisdiction":"us-ky","citation":"KRS 367.401","heading":"Disclosure of refund requirement and that savings claims are based on","body":"comparisons with retailers doing business in area.\n(1) Every contract shall provide that if any goods ordered by the member from the\nbuying club are not delivered to the member or a vailable for pickup by the member\nat a location within his county of residence within six (6) weeks from the date the\nmember placed an order for such goods, then any moneys paid by the member for\nsuch goods in advance of delivery shall, upon the member's r equest, be fully\nrefunded, unless a predetermined delivery date has been furnished to the member in\nwriting at the time he or she ordered such goods and the goods are delivered to the\nmember or are available for pickup by that date.\n(2) Every contract sha ll provide that all savings claims made by the buying club are\nbased on price comparisons with retailers doing business in the trade area in which\nthe claims are made and with prices at which the merchandise is actually sold.\n(3) Any contract which does n ot comply with subsections (1) and (2) of this section\nshall be void and unenforceable.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34954","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:03Z","sha256":"026573d11d8fbd99cce4bd04c4ab449af4c860e8a5e1424aa9ffeacd1429efd0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.399","next":"us-ky/krs-367.403"},"notice":"GroundRules: Original legal text.
