{"data":{"id":"us-ky/krs-367.4082","jurisdiction":"us-ky","citation":"KRS 367.4082","heading":"Prohibited solicitation of person involved in motor vehicle accident by a","body":"healthcare provider or intermediary.\n(1) During the first thirty (30) days following a motor vehicle accident a healthcare\nprovider or an intermediary, at the request or direction of a healthcare provider,\nshall not solicit or knowingly permit another individual to solicit a person involved\nin a motor vehicle accident for the provision of reparation benefits, as defined by\nKRS 304.39-020(2).\n(2) A healthcare provider shall not:\n(a) Pay or receive compensation for the referral or solicitation of reparation\nbenefits for a person involved in a motor vehicle accident;\n(b) Provide monetary compensation or other consideration to any individual for\nthe purpose of inducing, enticing, or dire cting the provision of reparation\nbenefits for a person involved in a motor vehicle accident; or\n(c) Contact, request, or direct an intermediary to contact, for the purpose of\nsolicitation, a person involved in a motor vehicle accident during the first\nthirty (30) days following a motor vehicle accident.\n(3) A healthcare provider shall be responsible for the content of any contact, made at\nthe direction or request of the healthcare provider, by an intermediary with a person\ninvolved in a motor vehicle accid ent within the first thirty (30) days following the\nmotor vehicle accident involving a person.\n(4) Any healthcare provider having knowledge of facts, actual or direct, of a violation\nof this section by another healthcare provider, an intermediary, or on be half of the\nhealthcare provider within their scope of practice, shall report the suspected\nviolation to the appropriate board listed in KRS 367.4081(1).\n(5) An individual licensed or certified as a healthcare provider, who violates this\nsection, shall be s ubject to the disciplinary process of the respective licensing or\nregulatory authority.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44403","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:03Z","sha256":"f344e827bf2bbf2ccbb173a39461560206f39941fed7e4743a74039b9a03f835","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.4081","next":"us-ky/krs-367.4083"},"notice":"GroundRules: Original legal text.
