{"data":{"id":"us-ky/krs-367.463","jurisdiction":"us-ky","citation":"KRS 367.463","heading":"Consent to calls made with automated calling equipment -- Written","body":"consent -- Withdrawal of written consent -- Period of validity of written\nconsent.\n(1) A person may consent to a call made with automated calling equipment when:\n(a) A live operator int roduces the call and states an intent to play a recorded\nmessage; or\n(b) By using the telephone keypad to provide a consent response.\nConsent obtained pursuant to this subsection applies only to the particular call and\ndoes not constitute prior consent to  receive further calls through automated calling\nequipment.\n(2) A person may consent to receive telephone calls through automated calling\nequipment by giving written consent to the person using automated calling\nequipment or causing it to be used.\n(a) Any form used to obtain written consent shall state clearly and conspicuously\nits purpose and effect and shall clearly and conspicuously give notice of how\nthe consent can be withdrawn.\n(b) A record of written consent shall be maintained by the person to whom\nconsent is given and shall be made available to the Attorney General or his\nauthorized representative during normal business hours and upon twenty -four\n(24) hours' notice.\n(c) A written consent to receive telephone calls through automated calling\nequipment shall be void on and after the fifteenth day after receipt of a letter\nwithdrawing the consent.\n(d) Unless withdrawn, a written consent shall be valid for two (2) years from the\ndate on which it is executed; the record of written consent shall be maintain ed\nby the person to whom consent is given for at least the same period of time.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34965","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"4f37513cc95a29dd63790f13224bbe6d2b36ff45cd11bccf4a63c11b71802f6f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.461","next":"us-ky/krs-367.465"},"notice":"GroundRules: Original legal text.
