{"data":{"id":"us-ky/krs-367.469","jurisdiction":"us-ky","citation":"KRS 367.469","heading":"Requirement of permit from Attorney General -- Surety bond -- Authority","body":"to promulgate administrative regulations.\n(1) Unless covered by one (1) of the exceptions in KRS 367.461(3), and prior to using\nautomated calling equipment to call telephone numbe rs in this Commonwealth, a\nperson or company shall first obtain a permit from the Attorney General. The\napplication for permit shall include:\n(a) Name, address, and telephone number of the company or person utilizing the\nequipment;\n(b) If the address required by paragraph (a) of this subsection is not in Kentucky,\nthe name and address of a designated agent for the automated calling\nequipment operator located in Kentucky;\n(c) A surety bond executed by the automated calling equipment operator from a\nsurety company authorized to do business in this Commonwealth for the sum\nof ten thousand dollars ($10,000), to be maintained continuously in full force\nand effect. The Attorney General may accept an alternate form of surety, such\nas a letter of credit, for an operator demonstrating financial responsibility.\n(2) The Attorney General shall promulgate administrative regulations to govern the\nissuance, revocation, suspension, or reissuance of permits for automated calling\nequipment operators utilizing equipment to call  telephone numbers located in\nKentucky. The Attorney General may revoke permits for any violation of KRS\n367.461, 367.463, or 367.465, following an administrative hearing conducted in\naccordance with KRS Chapter 13B.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34968","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"9c3aedfcc4aa102eb5ebee6663eaf0f1de2e8cf42c24975858585957fbc98f2a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.467","next":"us-ky/krs-367.46951"},"notice":"GroundRules: Original legal text.
