{"data":{"id":"us-ky/krs-367.46961","jurisdiction":"us-ky","citation":"KRS 367.46961","heading":"Cancellation of contract not reduced to writing -- Exception.","body":"(1) Unless the contract is reduced to writing in compliance with subsection (4) of this\nsection, a consumer may cancel a contract made as a result of a telephone\nsolicitation and obtain a full refund of all money paid, by returning the goods, if\nany, undamaged and unused, or canceling services within the later of:\n(a) Fourteen (14) calendar days following receipt of the goods; or\n(b) Fourteen (14) calendar days following receipt of two (2) copies of a written\nnotice of cancellation rights containing the followi ng language in no less than\nten (10) point, bold-faced type:\nNOTICE OF CANCELLATION RIGHTS\nBECAUSE YOU AGREED TO BUY THESE GOODS (or services or\nother appropriate description) AS A RESULT OF AN UNSOLICITED\nTELEPHONE CALL, KENTUCKY LAW GIVES YOU FOURTEE N\n(14) DAYS TO CANCEL YOUR AGREEMENT WITH US.  IF YOU\nWANT TO CANCEL, YOU MUST SIGN YOUR NAME BELOW\nAND RETURN A COPY OF THIS NOTICE, TOGETHER WITH\nANY GOODS YOU HAVE RECEIVED, SO THEY ARE\nPOSTMARKED NO LATER THAN MIDNIGHT OF THE\nFOURTEENTH DAY FOLLOWING T HE DATE YOU RECEIVED\nTHE GOODS OR AGREED TO THE SERVICES, OR THE\nFOURTEENTH DAY FOLLOWING THE DATE YOU RECEIVED\nTHIS NOTICE, WHICHEVER IS LATER. THE NOTICE AND\nGOODS MUST BE ADDRESSED AS FOLLOWS:\n(Name and address of Merchant)\nI want to cancel my agreement to purchase.\n____________________________________\n(Signature)\n____________________________________\n(Name of Consumer - Printed)\n____________________________________\n(Address of Consumer - Printed)\n____________________________________\n(Address - City, State, Zip)\n____________________________________\n(Date)\n(2) The consumer shall be deemed to have complied with subsection (1) of this section\nif the cancellation notice and goods, if any, are returned to the merchant and are\npostmarked by midnight of the fourteenth day.\n(3) The merchant shall process the refund due any consumer within thirty (30) days of\nreceiving the merchandise returned by the consumer or the written cancellation\nprovided in subsection (1) of this section.\n(4) The cancellation period provided in subsection (1) of this section shall not apply to\na written contract signed by the consumer that:\n(a) Complies with all applicable federal and state laws and regulations:\n(b) Contains a description of the goods, services, investm ent or business\nopportunity, extension of credit, or interest in realty matching the description\nused in the telephone solicitation;\n(c) Contains the name, address, and telephone number of the merchant, the total\nprice of the contract, including any financ e or interest charges, and a detailed\ndescription of the goods, services, credit, or interest in realty being offered;\n(d) Contains all oral or written representations made to the consumer in\nconnection with the transaction; and\n(e) Sets out in at least te n (10) point, bold -face type, immediately preceding the\nsignature, the following statement:\nYOU ARE NOT OBLIGATED TO PAY ANY\nMONEY UNLESS YOU SIGN THIS CONTRACT\nAND RETURN IT TO THE MERCHANT.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34973","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"99329cd73c6452741b16681d4671625bc4db2e8032327ab9134f28f81a4b1171","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.46957","next":"us-ky/krs-367.46963"},"notice":"GroundRules: Original legal text.
