{"data":{"id":"us-ky/krs-367.46994","jurisdiction":"us-ky","citation":"KRS 367.46994","heading":"Transfer of numbers on zero call list to national Do Not Call Registry --","body":"Consumer education materials -- Publication of materials by telephone\ncompanies.\n(1) The Office of the Attorney General immediately shall request that the Federal Trade\nCommission include on the national Do Not Call Registry the residential numbers\nthat were placed on the zero call list on or before June 26, 2007. If the Federal\nTrade Commission denies the request, then those households whose residential\nnumbers will be purged from the zero call list shall be informed by the Office of the\nAttorney General on how to place their telephone number on the national Do Not\nCall Registry.\n(2) Persons whose telephone numbers appear on the zero call list shall not receive\ntelephone solicitations except in accordance with the provisions of KRS 367.46951\nto 367.46999.\n(3) Information contained in a database established for the purpose of administering the\nzero call list shall be used only for the purpose of implementing the zero call\nprogram in conformance with KRS 367.46951 to 367.46999.\n(4) The Kentucky Public Service Commission shall produce consumer education\nmaterials that:\n(a) Describe Kentucky's telemarketing laws;\n(b) Describe the consumer's rights and responsibilities regarding the receipt of\ntelephone solicitation;\n(c) Explain how consumers can apply to be placed on any federal Do Not Call\nRegistry established by the Federal Communications Commission and the\nFederal Trade Commission;\n(d) Explain how to apply to be placed on comp any-specific and industrywide no\nsolicitation calls list, including those lists provided by the Direct Marketing\nAssociation (DMA) and the Telephone Preference Service (TPS); and\n(e) Describe how a consumer can file a complaint if the consumer receives cal ls\nafter being placed on the Do Not Call Registry established by the Federal\nCommunications Commission and the Federal Trade Commission.\n(5) The Public Service Commission shall require that, once a year, telephone\ncompanies under the jurisdiction of the Pu blic Service Commission shall include\nthe customer education material or portions thereof, at the discretion of the\ncompanies, in either the billing inserts, billing messages, or in the Customer Guide\npages of their telephone directories.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34984","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"c657a5a36224f981bc931efd3e2480f2f5bd023e8c03acf70c0b8ffef7c51484","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.46993","next":"us-ky/krs-367.46995"},"notice":"GroundRules: Original legal text.
