{"data":{"id":"us-ky/krs-367.472","jurisdiction":"us-ky","citation":"KRS 367.472","heading":"Definitions.","body":"Unless the context otherwise requires, the following terms shall mean:\n(1) \"Recreational and retirement use\" land means that land which is sold and promoted\nwith primary emphasis on the land's value for recreational purposes or for\nretirement purposes. In order to carry out the purposes of KRS 367.470 to 367.486,\nthe Attorney General may by administrative regulations further define the term\n\"recreational and retirement use\" of land;\n(2) \"Offer\" includes every inducement, solicitation, or attempt to encourag e a person to\nacquire an interest in land;\n(3) \"Person\" means an individual, corporation, government, or governmental\nsubdivision or agency, business trust, estate, partnership, unincorporated\nassociation, two (2) or more of any of the foregoing having a j oint or common\ninterest or any other legal or commercial entity;\n(4) \"Purchaser\" means a person who acquires or attempts to acquire or succeeds to an\ninterest in land;\n(5) \"Subdivider\" means any owner of subdivided land who offers it for disposition or\nthe principal agent of the owner.\n(6) \"Subdivision and subdivided lands\" means any land which is divided or is proposed\nto be divided for the purpose of disposition into ten (10) or more lots, parcels, units,\nor interests and also includes any land, whether c ontiguous or not, if ten (10) or\nmore lots, parcels, units, or interests are offered as a part of a common promotional\nplan of advertising and sale.\n(7) \"Land\" and \"interest in land\" mean any right to own, use, or enjoy land, including,\nbut not limited to,  fee estates, life estates, leasehold estates, easements, undivided\ninterests, licenses, and any other legal or equitable interest in real property but not\nincluding interests in the nature of personal property which are nontransferable by\nthe purchaser.\n(8) \"Development\" means the recreational and retirement use land itself together with\nany existing or future common areas, undeveloped land, improvements, or\namenities which are or have been advertised or used to induce the purchase of\nrecreational and reti rement use land irrespective of whether particular\nimprovements or amenities existed at the time of sales to particular individuals.\n(9) \"Consumer credit contract\" means any instrument which evidences or embodies a\ndebt incurred by a natural person for the  purchase, lease, or use of recreational and\nretirement use land which is intended for personal, family, or household use.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=34988","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"257d073d99047e7ce41ef63124f41faed88560fac53ad0d3b1863bccfe73a4b5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.470","next":"us-ky/krs-367.474"},"notice":"GroundRules: Original legal text.
