{"data":{"id":"us-ky/krs-367.484","jurisdiction":"us-ky","citation":"KRS 367.484","heading":"Attorney General's ability to obtain restraining order -- Availability of","body":"remedies of Consumer Protection Act -- Authority to promulgate\nadministrative regulations.\n(1) When the Attorney General has reason to believe that any person is offering\nrecreational and retirement use land for sale in violation of KRS 367.470 to 367.486\nor any administrative regulations issued by the Attorney General pursuant to KRS\n367.480, and that proceedings would be in the public interest, he may move in the\nname of the Co mmonwealth in a Circuit Court for a restraining order or temporary\nor permanent injunction to prohibit the offer. The action may be brought in the\nCircuit Court in the county in which the person resides or has his principal place of\nbusiness or in the Circuit Court of the county in which the unlawful offer or sale has\nbeen or is about to be committed, or in the county in which the land is situated.\n(2) A violation of KRS 367.472, 367.474, 367.477, 367.4774, 367.4776, and 367.4778\nshall be deemed to be an unfair, false, misleading, or deceptive act or practice in the\nconduct of trade or commerce in violation of KRS 367.170.\n(3) All the remedies, powers, and duties provided for the Attorney General by KRS\n367.190 to 367.300 and 367.990, pertaining to acts decl ared unlawful by KRS\n367.170, shall apply with equal force and effect to acts declared unlawful by KRS\n367.470 to 367.486.\n(4) Nothing in KRS 367.470 to 367.486 shall be construed to limit or restrict the\nexercise of powers or the performance of the duties  of the Attorney General which\nhe is authorized to exercise or perform under any other provision of law.\n(5) The Attorney General shall have the authority to adopt other administrative\nregulations he deems necessary for the proper administration of this chapter.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35001","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"d19ba05980011c6084e207a841d03c7266b4a3ac807f002ef6cada33f23b89c9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.482","next":"us-ky/krs-367.486"},"notice":"GroundRules: Original legal text.
