{"data":{"id":"us-ky/krs-367.4915","jurisdiction":"us-ky","citation":"KRS 367.4915","heading":"Activities exempt from KRS 367.4905 to 367.4917.","body":"Except as provided in KRS 367.4911(9), the requirements of KRS 367.4905 to 367.4917\nshall not apply to the following:\n(1) Excavation by an operator on its own easement except where that easement is\ncrossed by another operator's facilities;\n(2) Routine road maintenance or railroad maintenance or repairs;\n(3) Tilling of soil for agricultural purposes;\n(4) Excavators excavating on private property, using nonmechanized equipment, if\nthere is no encroachment on any operator's right-of-way or easement;\n(5) The opening of a grave in a cemetery;\n(6) A solid waste disposal site which is properly permitted;\n(7) Coal mining operations which are currently regulated under KRS Chapter 350;\n(8) A utility operator or utility operator subcontractor performing emergency work as\ndefined in KRS 367.4903;\n(9) Leak migration testing using metal probes inserted by hand by an authorized\nrepresentative of the operator;\n(10) Any nonintrusive excavating performed by an operator or his or her subcontractor\nto locate the operator's underground facilities in response to a notice of excavation\nfrom the notification center, if all reasonable precautions have been taken to protect\nthe underground facilities;\n(11) Nonintrusive excavating to inspect or perform maintenance for an existing utility\npole; or\n(12) Connection or disconnection of communications lines within a private or public\neasement or right -of-way by means of nonintrusive excavating when the depth of\nthe excavations is not greater than twelve (12) inches and is completed within\ntwelve (12) inches of a communications service provider's own communications\nnetwork.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54791","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"c433c27cfdd2e02c681b44270fe598e64426e55a7aee6217da7bb9646851f2fb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.4913","next":"us-ky/krs-367.4917"},"notice":"GroundRules: Original legal text.
