{"data":{"id":"us-ky/krs-367.580","jurisdiction":"us-ky","citation":"KRS 367.580","heading":"Contents of promotional material -- Time limits for mailing.","body":"(1) In connection with the use of any negative option plan, promotional material shall\nclearly and conspicuously disclose the material terms of the plan, including:\n(a) That aspect of the plan under which the subscriber must notify the seller, in\nthe manner p rovided for by the seller, if he does not wish to purchase the\nselection;\n(b) Any obligation assumed by the subscriber to purchase a minimum quantity of\nmerchandise;\n(c) The right of a contract -complete subscriber to cancel his membership at any\ntime;\n(d) Whether billing charges will include an amount for postage and handling;\n(e) A disclosure indicating that the subscriber will be provided with at least ten\n(10) days in which to mail any form, contained in or accompanying an\nannouncement identifying the selection, to the seller;\n(f) A disclosure that the seller will credit the return of any selections sent to a\nsubscriber, and guarantee to the postal service or the subscriber postage to\nreturn such selections to the seller when the announcement and for m are not\nreceived by the subscriber in time to afford him at least ten (10) days in which\nto mail his form to the seller;\n(g) The frequency with which the announcements and forms will be sent to the\nsubscriber, and the maximum number of announcements and forms which will\nbe sent to him during a 12-month period.\n(2) In connection with the use of any negative option plan, prior to sending any\nselection, the seller shall mail to its subscribers, within the time specified by\nsubsection (3) of this section:\n(a) An announcement identifying the selection;\n(b) A form, contained in or accompanying the announcement, clearly and\nconspicuously disclosing that the subscriber will receive the selection\nidentified in the announcement unless he instructs the seller tha t he does not\nwant the selection, designating a procedure by which the form may be used for\nthe purpose of enabling the subscriber so to instruct the seller, and specifying\neither the return date or the mailing date.\n(3) The seller shall mail the announce ment and form either at least twenty (20) days\nprior to the return date or at least fifteen (15) days prior to the mailing date, or\nprovide a mailing date at least ten (10) days after receipt by the subscriber,\nprovided, however, that whichever system the seller chooses for mailing the\nannouncement and form, such system must provide the subscriber with at least ten\n(10) days in which to mail his form.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35021","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"52305b99adbfd5a194a34d76c3fb2ee56cdae6a8c0dc41c42de490087cb91d64","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.575","next":"us-ky/krs-367.585"},"notice":"GroundRules: Original legal text.
