{"data":{"id":"us-ky/krs-367.610","jurisdiction":"us-ky","citation":"KRS 367.610","heading":"Assignee of rights of seller or lessor subject to defenses of buyer against","body":"seller or lessor -- Exception.\n(1) With respect to any consumer credit contract taken in connection with any purchase\nmoney loan or any sale or lease of goods or services othe r than credit card\ntransaction, an assignee of the rights of the seller or lessor is subject to all defenses\nof the buyer against the seller or lessor arising out of the sale or lease\nnotwithstanding an agreement to the contrary, but the assignee's liabili ty under this\nsection may not exceed the amount owing to the assignee at the time the defense is\nasserted against the assignee. Rights of the buyer or lessee under this section can\nonly be asserted as a matter of defense to or set off against a claim by the assignee.\n(2) This section shall not apply to any consumer credit contract taken in connection\nwith any purchase money loan or any sale or lease of goods or services which is in\ncompliance with any trade regulation issued or promulgated by the Federal Tr ade\nCommission or any regulation of the Board of Governors of the Federal Reserve\nSystem or similar federal agency having jurisdiction relating to preservation of\nconsumer claims and defenses in credit transactions.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35024","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"4705a3d43c624bbdf0bbe9e5cc9239b0731561d91d481dd9638c8ae3fa21a3ed","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.600","next":"us-ky/krs-367.620"},"notice":"GroundRules: Original legal text.
