{"data":{"id":"us-ky/krs-367.626","jurisdiction":"us-ky","citation":"KRS 367.626","heading":"Definition of \"emergency goods or services\" -- Advance payments","body":"prohibited during cancellation period -- Return of payments or notes of\nindebtedness -- Unenforceable contract provisions -- Contractor's right to\ncollect reasonable amount for goods and services provided.\n(1) As used in this section, \"emergency goods or services\" means goods, services, or\ngoods and services to immediately respond to a sudden, unexpected occurrence that\nposes a clear and imminent danger requiring immediate a ction to prevent or\nmitigate the loss or impairment of life, health, property, or essential public services.\n(2) Except as provided in subsection (3) of this section:\n(a) A contractor shall:\n1. Not require any advance payments under a real estate goods or services\ncontract until the cancellation period provided in KRS 367.622 has\nexpired; and\n2. Tender to the payor any payments, partial payments, or deposits made,\nand any note or other evidence of indebtedness provided, to the\ncontractor under a real estate  goods or services contract within ten (10)\ndays after the contract has been cancelled under KRS 367.622; and\n(b) 1. A real estate goods or services contract shall not be enforceable against\nany person who entered into the contract with the contractor if t he\ncontract:\na. Has been cancelled under KRS 367.622; or\nb. Contains a price that violates KRS 367.374.\n2. A person shall not be required to pay a cancellation fee or any other fee\ncontained in, or required under, a contract that is not enforceable against\nthe person under subparagraph 1. of this paragraph.\n(3) A contractor that provides any repair services or emergency goods or services\nauthorized under a real estate goods or services contract that is not enforceable by\nthe contractor under subsection (2)(b) of this section, including but not limited to\nrepair services necessary to prevent further damage to the premises, shall be entitled\nto collect a reasonable and customary amount for the goods, services, or goods and\nservices provided.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57392","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"377b6b24505f7c17d88f36957be5240b0fefc89a708db172098ea7e39d96655f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.624","next":"us-ky/krs-367.627"},"notice":"GroundRules: Original legal text.
