{"data":{"id":"us-ky/krs-367.627","jurisdiction":"us-ky","citation":"KRS 367.627","heading":"Enforcement by Attorney General -- Actions for injunctive relief and","body":"recovery of actual economic damages -- Civil penalty.\n(1) The Attorney General shall enforce KRS 367.620 to 367.628.\n(2) All of the remedies, powers, and duties provided  to the Attorney General under\nKRS 367.110 to 367.300, and the penalties provided in KRS 367.990, pertaining to\nany violation of KRS 367.110 to 367.300, shall apply with equal force and effect to\na violation of KRS 367.620 to 367.628.\n(3) (a) The Attorney General may institute an action in any court of competent\njurisdiction against any person alleged to have violated KRS 367.620 to\n367.628.\n(b) A person injured by a violation of KRS 367.620 to 367.628 may institute an\naction in any court of competent juris diction against any person alleged to\nhave committed the violation.\n(c) In any action brought under this subsection, if the court finds that the person\nhas committed one (1) or more violations of KRS 367.620 to 367.628:\n1. The plaintiff may:\na. Obtain an injunction to enjoin a continuance of the unlawful\nactivity;\nb. Recover from the defendant two (2) times the amount of any\nactual economic damages sustained, which shall be paid to the\ninjured person or persons; and\nc. Be awarded reasonable attorney's fees and costs; and\n2. In addition to the remedies and penalties pro vided under subparagraph\n1. of this paragraph, the Attorney General may recover a civil penalty of\nfive thousand dollars ($5,000) per violation.\n(4) It shall not be necessary that actual economic damages be alleged or proved in order\nto recover any other remedy or penalty authorized under this section.\n(5) (a) The remedies and penalties prescribed in KRS 367.620 to 367.628 shall be\ncumulative.\n(b) KRS 367.620 to 367.628 shall not be construed to limit or restrict the powers,\nduties, remedies, or penalties a vailable to the Attorney General, the\nCommonwealth, or any other person under any other statutory or common\nlaw.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57394","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"c218e05f7d382dfa66208feeee6e4816e673c94c61a13048774e745ec79f6e96","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.626","next":"us-ky/krs-367.628"},"notice":"GroundRules: Original legal text.
