{"data":{"id":"us-ky/krs-367.628","jurisdiction":"us-ky","citation":"KRS 367.628","heading":"Acts prohibited for contractor.","body":"(1) (a) Except as provided in paragraph (c) of this subsection, a contractor, or person\nrepresenting a contractor, shall not:\n1. Represent, negotiate, or advertise to represent or negotiate, as a public\nadjuster or otherwise, on behalf of any insured on any insurance claim in\nconnection with the provision of goods or services relating to real estate;\nor\n2. Represent or market the contractor or person, any employee or agent of\nthe contractor or person, or any business of the contractor or person as:\na. A claims specialist or expert;\nb. An insurance specialist or expert; or\nc. Having any affiliation with an insurer or an insurer's agent.\n(b) Any provision of a contract between a contractor, or a person representing a\ncontractor, and an insured in violation of paragrap h (a)1. of this subsection\nshall not be enforceable.\n(c) Nothing in this subsection shall be construed to prohibit a contractor, or\nperson representing a contractor, from:\n1. Providing an estimate for the provision of goods or services relating to\nreal estate; or\n2. Conferring with an insurance company's represe ntative about damage to\nreal estate after a claim has been submitted by an insured.\n(2) Where goods or services relating to real estate are expected to be paid from\nproperty, casualty, or property and casualty insurance proceeds, a contractor or\nperson representing a contractor shall not:\n(a) Cause, or command or encourage another person to cause, damage to any part\nof the real estate in order to:\n1. Increase the scope of goods or services provided; or\n2. Secure a contract for goods or services;\n(b) Offer to pay or rebate all or any portion of an insurance deductible or claims\nproceeds as an inducement to the sale of goods or services by a contractor;\n(c) Grant an allowance or discount against the fee to be charged by a contractor;\n(d) Pay or offer to pay the insured, or his or her representative, for whom services\nhave been or will be performed, for any reason, any form of compensation in\nexcess of one hundred dollars ($100), including but not limited to a:\n1. Bonus;\n2. Coupon;\n3. Credit;\n4. Gift;\n5. Prize;\n6. Referral fee; or\n7. Any other item having a monetary value;\n(e) Be financially connected, directly or indirectly, to any of the following in the\nprovision of the goods or services relating to real estate:\n1. A public adjuster;\n2. An appraiser; or\n3. Any other person that specializes in:\na. Investigating, negotiating, or effecting the settlement of an\ninsurance claim;\nb. Providing estimates other than estimates for goods or services\nrelating to real estate;\nc. Insurance; or\nd. Supplements;\n(f) Solicit or provide contracts on behalf of any other person or business engaged\nin a claim under the policy for services that are outside the contractor's scope\nof work, including but not limited to contracts for appraisers, public adjusters,\nor any other person that specializes in:\n1. Investigating, negotiating, or effecting the settlement of an insurance\nclaim;\n2. Providing estimates other than estimates for goods or services relating to\nreal estate;\n3. Insurance; or\n4. Supplements; or\n(g) File or claim a mechanic's lien pursuant to KRS 376.010 against an insured by\nreason of the insured's failure or refusal to pay any excess charge over and\nabove the amount paid or expected to be paid by an insurer under a property,\ncasualty, or property and casualty insurance policy.\n(3) In addition to being a violation of this section, a violation of subsection (2)(a) of\nthis section shall also be:\n(a) A fraudulent insurance act in violation of KRS 304.47-020; and\n(b) Criminal mischief in the first degree in violation of KRS 512.020.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57393","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"3d1f5d13e26560f10aa7757cf92f6e76a38de3bcaa31c2baec1d9a674edb6f95","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.627","next":"us-ky/krs-367.630"},"notice":"GroundRules: Original legal text.
