{"data":{"id":"us-ky/krs-367.634","jurisdiction":"us-ky","citation":"KRS 367.634","heading":"Cause of action -- Notice.","body":"(1) An owner, assignee, authorized agent, or exclusive licensee of a commercial\nrecording or audiovisual work electronically disseminated by a Web site or online\nservice in violation of KRS 367.632 may bring a private cause of action to obtain a\ndeclaratory judgment that an act or practice violates KRS 367.632 and obtain an\ninjunction against any person who knowingly has violated, is violating, or is\notherwise likely to violate that section. As a condition precedent to filing a civil\naction under KRS 367.630 to  367.638, the aggrieved party must make reasonable\nefforts to place an individual alleged to be in violation of KRS 367.632 on notice of\nthe alleged violation and that failure to cure within fourteen (14) business days may\nresult in a civil action filed in a court of competent jurisdiction.\n(2) Upon motion of the party instituting the action, the court may make appropriate\norders to compel compliance with KRS 367.632.\n(3) The prevailing party in a cause under subsection (1) of this section is entitled to\nrecover necessary expenses and reasonable attorney's fees.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52620","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:04Z","sha256":"e7b1b90dbd1e7def11c536af8becbf0738471a8ce031b1d0d566740aedef6511","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.632","next":"us-ky/krs-367.636"},"notice":"GroundRules: Original legal text.
