{"data":{"id":"us-ky/krs-367.683","jurisdiction":"us-ky","citation":"KRS 367.683","heading":"Verification of contact lens prescription.","body":"(1) All contact lens sellers and any person authorized in accordance with KRS Chapters\n320, 315, or 326 to dispense contact lenses in the Commonwealth shall verify the\ncontact lens prescription by the following:\n(a) Receipt of a written or faxed valid contact lens prescription signed by the\nprescribing optometrist, osteopath, or physician; or\n(b) An electronic or oral affirmative communication of the complete contact lens\nprescription from the prescribing optometrist, osteopath, or physician.\n(2) If a contact l ens seller or any person authorized to dispense contact lenses in the\nCommonwealth finds it necessary to contact the prescribing optometrist, osteopath,\nor physician via telephone in order to verify a contact lens prescription, the\nfollowing protocols shall be followed:\n(a) Calls shall be made during regular business hours;\n(b) Any verification requests shall include the name, address, and telephone\nnumber of the patient;\n(c) The toll -free telephone number as required by KRS 367.687(7) shall be\nincluded in voice mail or messages left on answering machines;\n(d) Contact lens prescriptions shall not be mailed, sent, delivered, or dispensed\nbefore verification by the optometrist, osteopath, or physician;\n(e) Touch-tone telephone options offered by a contact lens  seller or any person\nauthorized to dispense contact lenses in the Commonwealth shall not\nconstitute verification; and\n(f) Response-time options stated by a contact lens seller or any person authorized\nto dispense contact lenses in the Commonwealth shall n ot constitute\nverification.\n(3) In the absence of a prescription as defined and described in KRS 367.680 and\n367.681, it shall be a violation of KRS 367.680 to 367.690 to dispense contact\nlenses through the mail or otherwise to a Kentucky resident.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47637","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:05Z","sha256":"96827e7da8e8e4753562e5ffed337957ab47be19f81040ce0cda30cdf6bb916b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.682","next":"us-ky/krs-367.684"},"notice":"GroundRules: Original legal text.
