{"data":{"id":"us-ky/krs-367.687","jurisdiction":"us-ky","citation":"KRS 367.687","heading":"Registration of nonresident contact lens sellers with Attorney General.","body":"The Attorney General shall require and provide for the annual registration of all contact\nlens sellers located outside of the Commonwealth that dispense contact lenses to\nKentucky residents, including those providing contact lenses via the Internet. A cont act\nlens seller's registration shall be granted upon the disclosure and certification by the seller\nof all of the following:\n(1) The seller is licensed or registered to distribute contact lenses in the state in which\nthe dispensing facility is located and from which the contact lenses are dispensed;\n(2) The location, names, and titles of all owners, partners, corporate officers, and the\nperson who is responsible for overseeing the dispensing of contact lenses to\nresidents of this state;\n(3) The seller has complied with and shall continue to comply with all lawful directives\nand appropriate requests for information from the appropriate agency of each state\nin which the seller is licensed or registered;\n(4) The seller shall respond to all requests for informat ion from the Attorney General\nwithin thirty (30) days from receipt of the request;\n(5) The seller shall maintain records of contact lenses dispensed to residents of this\nstate for a period of ten (10) years, and that the records shall be readily available for\ninspection by the Attorney General upon demand;\n(6) The seller shall provide a toll -free telephone service during its regular hours of\noperation for the sole purpose of responding to the patients in this state concerning\nquestions and complaints. All q uestions relating to eye care shall be referred to the\ndoctor prescribing the contact lenses;\n(7) The seller shall provide a toll -free telephone service during its regular hours of\noperation solely for optometrists, osteopaths, and physicians.\n(8) The sell er shall provide the following or a substantially equivalent written\nnotification to the patient whenever contact lenses are supplied: WARNING: IF\nYOU ARE HAVING ANY OF THE FOLLOWING SYMPTOMS REMOVE\nYOUR CONTACT LENSES IMMEDIATELY AND CONSULT YOUR EYE\nCARE PRACTITIONER BEFORE WEARING YOUR LENSES AGAIN:\nUNEXPLAINED EYE DISCOMFORT, WATERING, VISION CHANGE, OR\nREDNESS; and\n(9) The seller's license or registration, in the state in which the seller is licensed or\nregistered, has not been suspended or revoked, bu t should the seller be the subject\nof any investigation undertaken by the licensing or registering state, or should the\nseller's license or registration be suspended or revoked, then the seller shall\nimmediately notify the Attorney General of such actions.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47641","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:05Z","sha256":"01f136ea71860647c3de12d49e381e5da36ca90dce097dc740676d66827329d8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.686","next":"us-ky/krs-367.688"},"notice":"GroundRules: Original legal text.
