(Effective January 1, 2027)\n(1) (a) The Attorney General may take action necessary or appropriate to enforce\nKRS 367.701 to 367.709.\n(b) All of t he remedies, powers, and duties provided to the Attorney General by\nKRS 367.190 to 367.300 and 367.990, pertaining to acts and practices\ndeclared unlawful by KRS 367.170, shall apply with equal force and effect to\nacts and practices declared unlawful under KRS 367.701 to 367.709.\n(2) (a) After proper notice and opportunity for a hearing in accordance with KRS\nChapter 13B, the Attorney General may take any one (1) or more of the\nfollowing actions:\n1. Order a creditor, provider, administrator, or any other pe rson to cease\nand desist from conduct in violation of any provision of KRS 367.701 to\n367.709; and\n2. Impose a civil penalty of not more than five hundred dollars ($500) per\nviolation of any provision of KRS 367.701 to 367.709, except a civil\npenalty shall not exceed ten thousand dollars ($10,000) in the aggregate\nfor violations of a similar nature.\n(b) For purposes of paragraph (a) of this subsection, violations are of a similar\nnature if the violations consist of the same or similar course of conduct,\naction, or practice, irrespective of the number of times the action, conduct, or\npractice occurred.\n(3) Any person aggrieved by a final order issued by the Attorney General pursuant to\nthis section shall have the right of an appeal in accordance with KRS Chapter 13B.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58237","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:05Z","sha256":"3772dd0f6aabbd655561e3b24740f642560581278aeac4cdae8cf123beb221a5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.708","next":"us-ky/krs-367.710"},"notice":"GroundRules: Original legal text.
