{"data":{"id":"us-ky/krs-367.819","jurisdiction":"us-ky","citation":"KRS 367.819","heading":"Cancellation by purchaser.","body":"(1) The purchaser of a business opportunity has the right to cancel as set forth in this\nchapter as well as the right to cancel such purchase for any reason at any time prior\nto midnight of the thirtieth calendar day after signing a contract for purchasing the\nbusiness opportunity. In addition, the purchaser may cancel such purchase at any\ntime for the following violations:\n(a) Not providing locations as represented;\n(b) Failing to deliver goods or merchandising materials as represented; or\n(c) Failing to comply with KRS 367.809(2).\n(2) Cancellation occurs when the consumer/investor gives written notice to the offeror\nat the address given in the purchase agreement or otherwise provided by the offeror\nand the notice and statement of the buyer's right to cancel provided for in subsection\n(1) of this section.\n(3) Notice of cancellation, if given by mail, is given when it is deposited in the mail\nproperly addressed and postage prepaid.\n(4) Notice of cancellation given by the purchasers need not take a particular form and is\nsufficient if it indicates by form of written expression the intention of the buyer not\nto be bound by any contract to purchase the business opportunity.\n(5) Within fifteen (15) days after the date of notice of cancellation by the\nconsumer/investor, the seller must tender to the consumer/investor any payments as\nwell as shipping costs made by him and terminate all financial obligations created in\nconnection with the purchase of the business opportunity. Within five (5) days of\nrefund, the consumer/investor shall make available to the offeror the items delivered\nby the offeror.\n(6) Any waiver by the consumer/investor of a business opportunity of the rights\nprovided in this section is null and void, and will not operate to relieve the seller of\nany obligation placed upon him by this section.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35074","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:05Z","sha256":"88ee84821822cd97f7b354b93732d9e3f4febd532cb2c230e9bd5ce0480d798c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.817","next":"us-ky/krs-367.825"},"notice":"GroundRules: Original legal text.
