{"data":{"id":"us-ky/krs-367.841","jurisdiction":"us-ky","citation":"KRS 367.841","heading":"Definitions.","body":"(1) \"Buyer\" means any resident person who buys, contracts to buy, or leases a new\nmotor vehicle in the Commonwealth of Kentucky. In the case of the lease of a new\nmotor vehicle, \"buyer\" shall mean the lessor, lessee, or both.\n(2) \"Manufacturer\" means any perso n or corporation, resident or nonresident, who\nmanufactures or assembles new motor vehicles, including new conversion van\nmanufacturers, which are sold in the Commonwealth of Kentucky.\n(3) \"Motor vehicle\" means every vehicle which is self -propelled, and which is intended\nprimarily for use and operation on the public highways and required to be registered\nor licensed in the Commonwealth prior to such use or operation; however, \"motor\nvehicle\" shall not include:\n(a) Any vehicle substantially altered after its  initial sale from a dealer to an\nindividual;\n(b) Motor homes;\n(c) Motorcycles;\n(d) Mopeds;\n(e) Farm tractors and other machines used in the production, harvesting, and care\nof farm products; or\n(f) Vehicles which have more than two (2) axles.\n(4) \"New motor vehicle\" means a motor vehicle which has been finally and completely\nassembled and is in the possession of a manufacturer, factory branch, distributor,\nwholesaler, or an authorized motor vehicle dealer operating under a valid sales and\nservice agreement, franchise, or contract for the sale of such vehicle granted by the\nmanufacturer, factory branch, distributor, or wholesaler which is, in fact, new and\non which the original title has never been issued.\n(5) \"Express warranty\" or \"warranty\" means the writt en warranty, so labeled, of the\nmanufacturer of a new automobile, including any terms or conditions precedent to\nthe enforcement of obligations under the warranty.\n(6) \"Nonconformity\" means a failure to conform with an express warranty in a manner\nwhich substantially impairs the use, value, or safety of the motor vehicle.\n(7) \"Reasonable allowance for use\" means the amount directly attributable to a\nconsumer's use of the vehicle other than those time periods when the vehicle is out\nof service due to the nonconformity.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35087","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:05Z","sha256":"8f91842c431f2480f511307285b6ea5534461708eee41ced7f92b1330ad23275","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.840","next":"us-ky/krs-367.842"},"notice":"GroundRules: Original legal text.
