{"data":{"id":"us-ky/krs-367.930","jurisdiction":"us-ky","citation":"KRS 367.930","heading":"Action in Circuit Court -- Attorney's fees -- Effect of judgment -- Statute of","body":"limitations.\n(1) Any person who purchases a health spa membership or enters into a contract to\npurchase a health spa membership and thereby suffers any ascertainable loss o f\nmoney or property, real or personal, as a result of the use or employment by another\nperson or corporation of an act or practice declared unlawful by KRS 367.905 to\n367.920 may bring an action pursuant to the Rules of Civil Procedure in the Circuit\nCourt in which the seller resides or has his principal place of business or is doing\nbusiness, or in the Circuit Court in which the purchaser of the membership resides,\nor where the transaction occurred, to recover actual damages. The court may award\nsuch equitable relief as it deems necessary or proper. Nothing in this section shall be\nconstrued to limit a person's right to seek punitive damages where appropriate.\n(2) In any action brought by a person under this section, the court may award, to the\nprevailing p arty, in addition to the relief provided in this section, reasonable\nattorney's fees and costs.\n(3) Any permanent injunction, judgment, or order of the court made under KRS\n367.925 shall be prima facie evidence in an action under this section that the\nrespondent used or employed a method, act, or practice declared unlawful by KRS\n367.905 to 367.930.\n(4) Any person bringing an action under this section must bring such an action within\none (1) year after any action of the Attorney General has been terminated or within\ntwo (2) years after the violation of this section is discovered, whichever is later.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=35111","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:06Z","sha256":"0fed1e836a6f2d0767246e23b6b45fc4573d43f15ec2f77b8ede48dae0eef0b7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.925","next":"us-ky/krs-367.93101"},"notice":"GroundRules: Original legal text.
