{"data":{"id":"us-ky/krs-367.93103","jurisdiction":"us-ky","citation":"KRS 367.93103","heading":"Funeral planning declarations.","body":"(1) A person who is of sound mind and is at least eighteen (18) years of age may\nexecute a declaration.\n(2) (a) A declaration shall not be included in:\n1. A will;\n2. A power of attorney; or\n3. A similar document.\n(b) If a declaration is included in any of the documents listed in paragraph (a) of\nthis subsection, it shall not invalidate the document but the declaration\ncontained therein is not enforceable.\n(3) A declaration shall designate an individual to serve as the designee, or if no\ndesignee is designated s hall provide instruction concerning funeral services,\nceremonies, and the disposition of remains after death.\n(4) A declaration, at a minimum, shall be:\n(a) Voluntary;\n(b) In writing;\n(c) Signed by the declarant or by another person in the declarant's presence and at\nthe direction of the declarant;\n(d) Dated;\n(e) Signed in the presence of at least two (2) competent witnesses who are at least\neighteen (18) years of age at the time they sign the declaration; and\n(f) Acknowledged before a notary public or other person authorized to administer\noaths.\n(5) A declaration is not binding upon a funeral home, a cemetery, or any person\nengaged in the business of providing funeral services, selling merchandise or grave\nmarkers, or providing a service or other property subject to the declaration until the\nfuneral home, cemetery, or person receives full payment for the service,\nmerchandise, or other property.\n(6) A person is not considered to be entitled to any part of the declara nt's estate solely\nby virtue of being designated by the declarant to serve as his or her designee.\n(7) Unless an individual is related to the declarant by birth, marriage, or adoption, a\ndeclarant shall not designate an individual to be his or her designee  or alternate\ndesignee who is:\n(a) A provider of funeral or cemetery services; or\n(b) Employed by any entity that is responsible for providing funeral or cemetery\nservices or disposing of the declarant's remains.\n(8) The following shall not be a witness to a declaration:\n(a) The person who signed the declaration on behalf of and at the direction of the\ndeclarant; or\n(b) The person identified as the designee.","path":["KRS Chapter 367"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48287","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:59:06Z","sha256":"e65c5eb2701cca65a1151633e7a31935408b4c3371a6aab498a995bbe9809922","source_id":"us-ky","stale":false,"prev":"us-ky/krs-367.93101","next":"us-ky/krs-367.93105"},"notice":"GroundRules: Original legal text.
